Picking a septic company in Marion County

Start with the credential, because it is the one thing about a local septic company you can check yourself, free, in about two minutes. The septic tank contractor credential in Florida is a state registration rather than a license: section 489.553(2), Florida Statutes, makes the department responsible for granting certificates of registration, and section 489.551(1) defines that department as the Florida Department of Environmental Protection. Florida writes two grades into the statute, and which one you need depends on the job. Section 489.551(4) defines a septic tank contractor as one with the skill to install, maintain, repair and alter onsite systems, and to perform site evaluations for repairs where the site-evaluation expertise established by rule is met. Section 489.551(2) defines a master septic tank contractor as unlimited in the septic tank trade, and that definition is the one that names designing systems, where not prohibited by law, and performing and submitting soil evaluations. If your job turns on a design or a soil evaluation rather than a standard installation, ask which grade is doing that part, and ask the Department about your own property before you sign anything.

Reading what a septic company's registration actually says

Expect two dates on two different cycles. The Florida Department of Environmental Protection states that all septic tank contractor registrations expire annually on September 30, and that certificate of authorizations for septic tank contracting businesses expire March 31 of every odd year. The individual registration therefore turns over every year and the business certificate only in odd years, so the two dates you read are on different clocks and will often not line up.

An empty business search does not by itself mean a company is unregistered. DEP states that septic tank businesses structured as a sole proprietorship, operating under the owner's legal name, are not required to obtain a certificate of authorization, so a septic company trading under its owner's own name can be meeting that particular requirement and still return nothing when you search the business name. That is one requirement, not a verdict on everything else. What DEP does require is that all individuals who act on behalf of the business as contractors must be registered or master contractors. Registration is not a one-time credential. DEP requires registered contractors to include certificates of completion for at least 12 hours of approved continuing education for each 12 month renewal cycle, and a master septic tank contractor to include certificates for a minimum of 18 hours, at least six of which must be obtained in master level courses. Asking a septic company when it last renewed is a fair question to put on a first call.

Septic company near me: the registration belongs to a person

Whether you searched for a septic company near me or septic companies near me, two different records answer the question, and only one of them is the company. Section 489.555(1), Florida Statutes, states that nothing in that section means a certificate of registration to practice septic tank contracting is held by a corporation. People hold registrations. Businesses hold a certificate of authorization.

The same subsection sets what a company has to have behind the name. Practicing septic tank contracting through a corporation or a partnership is permitted provided that one or more principal officers of the corporation, or one or more partners of the partnership, and all personnel who act on its behalf as septic tank contractors or master septic tank contractors are registered, and provided the business has been issued a certificate of authorization by the department. Under section 489.555(2) that certificate is required of a corporation, partnership, association, or person practicing under a fictitious name and offering septic tank contracting services to the public, and an individual practicing in his or her own given name is not required to register under that section. It is the same distinction as the empty business search described above.

One person cannot be the sole qualifier for two companies. Section 489.555(1) says a registered contractor may not be the sole qualifying contractor for more than one business that requests a certificate of authorization. If a business loses its qualifying contractor it has 60 days from the date that person ends the affiliation to find another, and during that period it may complete any existing contract or continuing contract but may not undertake any new contract. The department may extend the period once, by another 60 days, on a showing of good cause. A septic company can therefore be mid-transition at the moment you call it, which is a question for the department about that company rather than something to read off a website.

Two more things in the statute are worth knowing before you hand over a deposit. Section 489.555(3) renews each certification of authorization every two years and requires a certified partnership or corporation to notify the department within one month of any change in the information contained in the application the certification is based on. Section 489.555(5) says that once a certificate of authorization has been revoked, a person authorized by law to provide septic tank contracting services may not use the name or fictitious name of that entity, or its other identifiers, including telephone numbers, advertisements, or logos. The name is not the only thing on that list.

Underneath all of it is section 489.552: a person shall not hold himself or herself out as a septic tank contractor or a master septic tank contractor in Florida unless registered by the department, and nothing in that part prohibits a person licensed under section 489.105(3)(m) from engaging in the profession for which he or she is licensed. Section 489.558(1) makes a violation of any provision of that part a misdemeanor of the first degree. We make no finding about any company, and we do not publish a shortlist.
